Chapter 7 Bankruptcy is often known as a "Fresh Start" bankruptcy, because it wipes the slate clean. Chapter 7 Bankruptcy allows a person to eliminate or discharge most or all of their debts like medical bills, deficiency judgments, personal loans and credit card debts. A person is allowed to keep exempt property. Property which is not exempt is sold, with the money distributed to the creditors. In many cases, an individual may keep their home or car (secured debt), provided that they continue to make current payments and are up to date on the loan. Many, but not all people are eligible to file a Chapter 7 Bankruptcy. Anyone who meets eligibility requirements, called a means test, is eligible to file a Chapter 7 Bankruptcy.
